1. Introduction

Welcome to The Highland Alchemists. These terms govern your use of our website and your purchase of products from us. By visiting our site, buying our products, or partnering with us for wholesale, you agree to be bound by these terms. We keep things simple, but a few ground rules help keep the magic flowing smoothly.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

3. Products, Safety & Usage

We craft atmospheres, but our products involve fire, heat, and concentrated oils. By purchasing our products, you agree to follow all safety instructions provided on the packaging and on our website.

  • Handmade Nature Our products are small batch and handmade. Slight variations in colour, scent throw, and finish are natural and part of the alchemy. These are not defects.

  • Candles You acknowledge that burning candles presents a fire risk. You agree to never leave a burning candle unattended, to keep it away from flammable objects, and to trim the wick before every use.

  • Wax Melts You agree to use these only in appropriate wax melt burners (electric or tea-light) and never to add water to the wax.

  • Reed Diffusers You acknowledge that diffuser oils can be flammable and can damage surfaces (such as polished wood, plastic, or painted surfaces) if spilled. You agree to wipe up any spills immediately and keep the product out of reach of children and pets.

  • Liability Disclaimer We are not liable for any damage (including fire damage or surface damage) or injury resulting from misuse, negligence, or failure to follow these safety instructions.

4. Retail Orders (B2C)

  • Pricing Prices for our products are subject to change without notice.

  • Accuracy We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

  • Local Delivery If you select local delivery, we will drop the products off at the address provided. Risk transfers to you once the item is delivered to your doorstep or specified safe place.

5. Wholesale and White Label (B2B)

The following terms apply specifically to our trade partners and white label clients.

  • Invoicing and Payment Unless otherwise agreed in writing, payment is due upon receipt of invoice. We reserve the right to withhold shipment until payment clears.

  • Shipping Costs For trade orders, shipping costs are the responsibility of the buyer. If we arrange shipping on your behalf, these costs will be added to your final invoice.

  • Strict Resale Restriction You are not authorised to resell our products (branded or white label) on third-party marketplaces (such as Amazon, Etsy, or eBay) or in any retail location without a specific, written agreement from The Highland Alchemists. Unauthorised resale is a breach of these terms and may result in the immediate termination of our business relationship and legal action.

6. Shipping and Delivery

  • General Shipping We aim to dispatch orders promptly. However, shipping times are estimates and not guarantees.

  • Risk of Loss All items purchased from The Highland Alchemists are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

7. Returns and Refunds

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately, we cannot offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

  • Damaged Goods If your item arrives damaged, please email hello@thehighlandalchemists.com with photos immediately so we can make it right.

8. Third Party Links

Certain content, products, and services available via our Service may include materials from third parties. Third party links on this site may direct you to third party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third party materials or websites.

9. User Comments and Feedback

If you send us creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation to maintain any comments in confidence.

Your submission of personal information through the store is governed by our Privacy Policy.

11. Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error free.

In no case shall The Highland Alchemists, our employees, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Scotland.
